Chapter Summary

This is the introduction chapter of the book, which is concerned with the legal implications of past and future EU pre-accession and accession treaty practices. It covers the Union's strategy for European Union enlargement, for candidate countries and the receiving Member States alike, both before enlargement as well as the legal arrangements that apply after an enlargement in order to smooth the transition of enlargement on 'old' and 'new' Member States. The book puts the general pre-accession strategy in its historical context and traces its evolution and influences. It highlights the particular problems facing today's pre-accession strategy. It then looks at Accession Treaty practice and how to smooth the entry of incoming countries into the Union post-enlargement: the legal framework for the transitional arrangements. It also concentrates on implications of pre-accession strategy and the transitional arrangements provided for in the fifth and sixth Accession Treaties for a number of reasons.
