Chapter Summary

The purpose of this chapter is, first, to present a general assessment of the European Arrest Warrant (EAW) based on recent developments, relevant case law and other reports and statistics, in all the cases from both a national and a European perspective. Secondly, and more importantly, it aims to study those aspects of the present legal instrument that are capable of affecting the core of 'essential guarantees', because these encapsulate some of the most problematic issues relating to the application of the EAW at a national level, due to the question mark that still hangs over the protection of essential guarantees in criminal proceedings.
