Title 1: Minimum Requirements For Seafarers To Work On A Ship

Chapter Summary

This chapter examines the regulations and the provisions in Part A and Part B of the Code of the MLC, 2006 in Title 2. Title 2 comprises regulations and the related Code Part A, Standards, and Part B, Guidelines on topics such as seafarers' employment agreements, wages, hours of work and hours of rest, entitlement to leave, repatriation, seafarers' compensation for the ship's loss or foundering, manning levels and career and skill development and opportunities for seafarers' employment. One of the regulations in Title 2 contains a key issue, how to define 'rest', a matter also addressed in the IMO's STCW Convention, as least for seafarers carrying out duties that are covered by the requirements of the STCW. The chapter shows the development and modernization of the existing maritime labour conventions that are consolidated by the MLC, 2006 as well as exploring some areas of potential difficulty in application.
