Chapter Summary

This chapter provides the litigation pursuant to Rule 54bis of the Rules of Procedure and Evidence of the International Criminal Tribunal for the former Yugoslavia (ICTY), which took place from almost the very beginning of the trial and which was still being energetically conducted at the time of the termination of the proceedings. It also provides the law applicable to the proceedings between the Prosecution and Serbia and Montenegro. The chapter outlines the many individual matters that constituted this almost three and a half years of litigation and discusses important substantive and procedural developments addressed by the Trial Chamber in its many decisions. It focuses the initial application of the Prosecution against Serbia and Montenegro for orders for the production of documentation for use in the Milosevic trial.
