Chapter Summary

This chapter first considers the status of the outer limit of the continental shelf in a case in which it has not yet become final and binding in accordance with the provisions of Article 76 of the Convention. Second, the existence of a land or maritime dispute may lead to a deadlock in the consideration of a submission by the Commission on the Limits of the Continental Shelf (CLCS). The reactions of Denmark and Iceland to the submissions imply that they submissions – at least for the time being – cannot be further considered by the Commission. After an overview of the issues involved in this case, the chapter proposes to discuss the options which are available to the Commission to deal with the existing situation. Finally, the chapter considers what options States have to deal with a deadlock in the consideration of a submission under the LOSC.
