Chapter Summary

All legal provisions in respect of third-country nationals adopted both at the national and the Union levels must comply with fundamental rights and EU principles of law as well as international human rights documents. This Chapter provides the framework for analysing EU legislation and national implementing measures in terms of Community law and international human rights obligations by giving an overview of the fundamental rights of migrants and general principles of law enshrined at the level of the EU, the Council of Europe and the international level. Next to EU fundamental rights and principles of law, international human rights documents that are relevant in the context of EU migration and integration law include Conventions and agreements adopted in the framework of the Untied Nations (UN), the International Labour Organisation (ILO) and the Council of Europe.
