Chapter Summary

This chapter provides several fundamental rights of third-country nationals, including the right to family life and family formation, employment-related rights, rights related to the integration of immigrants and the right to non-discrimination, as well as the general principle of subsidiarity. At the international level, the right to found a family, and the protection of the family unit, is mentioned in several human rights documents. The right to found a family is guaranteed in Article 16(1) UDH, Article 23(2) ICCPR and Article 9 of the Charter of Fundamental Rights. The European Union Directives equally contain certain work-related rights. International human rights documents contain certain standards with respect to the expulsion of third-country nationals. The UN Convention on Migrant Workers provides that states must take account of the length of residence and of humanitarian considerations when taking expulsion decisions.
