Chapter Summary

The creation of an intellectual property system in the People's Republic of China has taken place in phases, beginning with the early phase (1970s-1990s), followed by the development phase of nearly ten years beginning in the 1990s, and then finally the phase of further improvement in twenty-first century after China's accession to World Trade Organization (WTO). However, in view of the special historical background against which China's intellectual property system was created, the massive overhaul of intellectual property laws around the turn of the twenty-first century, and the new problems confronting us in this area, this chapter examines China's intellectual property system and explores the path for future work concerning intellectual property in China. The Guidelines for China's Intellectual Property Strategy expressly sets forth objectives to, by 2020, turn China into a country with a relatively high level of innovation, application, protection, and management of intellectual property rights.
