Chapter Summary

Thirty years have passed since the Standing Committee of National People's Congress approved in principle China's first laws on environmental protection on September 13, 1979. During those thirty years, China developed modern environmental laws from the ground up, creating an independent area of law that holds an important position in national legal system. This rapid development is due in part to the seriousness of China's environmental problems and the urgency with which these problems must be addressed, as well as an inevitable result of progression of China's legal system. The Environmental Protection Law played an important role in development of Chinese environmental law and had a far-reaching influence on environmental rule of law. First, the enactment of the law provided a legal foothold for environmental protection in China. Secondly, it provided a legal basis for the establishment of environmental protection institutions as well as outlining what their duties would be.
