Chapter Summary

This chapter conducts an interdisciplinary review of liabilities that will highlight the essence of liability, and to propose effective recommendations for an improved regime that will regulate and stimulate remote sensing activities. It discuses the Outer Space Treaty, the Liability Convention and the UN Remote Sensing Principles with close attention to the relevant provisions in each, and then examines the specific problems raised by the inadequate regime. The chapter examines the issues of liability from the standpoint of different branches and bases of law governing liability. It briefs the major defences that are relevant to remote sensing data supply: Act of God/ force majeure; contributory negligence; volenti non fit injuria; and liability disclaimers. The chapter attempts to clarify the concepts of intentional tort, gross negligence, and negligence, so as to set standards for establishing fault associated with satellite remote sensing activities.
