Chapter Summary

The document under review is an authorization to an agent for implementation in the land registry of all the legal acts required to effect the sale of a parcel of land that had already been completed. Three brothers belonging to al-Taʿāmira tribes sold to a woman, by a contract of absolute sale, a parcel of land. Now they empower the agent to accomplish the transaction at the land registry and to this end to represent them before all instances of civil court as well as the sharīʿa court. The sellers leave the agent full discretion to appoint tribal adjudicators and mediators to solve disputes concerning the specific parcel. The sharʿī legal formulations in the document can be easily traced back to the Mejelle. The document was presumably drafted by a lawyer well versed in land transactions in the Land Registry Office and in legal proceedings in the civil court.
