Chapter Summary

This chapter considers the content of the Long-term Residence Directive and investigates the implementation and possible interpretation of some of its provisions, notably Articles 3, 12 and 14. It examines Article 3, which defines the scope of the Directive. The chapter discusses the limitations, and compares them with the Commission's proposal. It indicates whether or not those limitations are applicable to European citizens. The main bulk of the analysis is to see how some Member States are interpreting this provision and how they are implementing it in their national legal orders. The situation before the adoption of the Directive is examined to see to what extent the position of the third-country national has changed. The chapter considers particular issues which have been the subject of interpretation by the Court of Justice of the European Union (CJEU) in the context of the Turkey Agreement.
