Chapter Summary

The rights of South Africa with regard to the living resources in its EEZ include determining the total allowable catch of the living resources during a specific period of time. When exercising those rights, South Africa must promote the objective of optimum utilization of the living resources in its EEZ. Fishery legislation has a long history in South African law. At present, the exploitation of living marine resources is governed by the MLRA complemented by the MLRR. South Africa is expected to &t;seek to harmonise national and regional policies, strategies and programmes related to the development and exploitation of mineral resources&t;. Moreover, South Africa agreed &t;to cooperate in facilitating the development of human and technological capacity and to jointly develop and observe internationally accepted standards of health, mining safety and environmental protection.
