Chapter Summary

This chapter presents a case from the Trial Chamber of the Special Court for Sierra Leone regarding a decision and order on defence preliminary motion on defects in the form of the indictment. The case was from the Prosecutor against Alex Tamba Brima, Brima Bazzy Kamara, and Santigie Borbor Kanu. The Court upholded the motion in part, and ruled that the Prosecution shall serve on the Defence, a certified true copy of the Case Summary accompanying the Indictment within three days of the date of service of the Decision. The form of the Indictment the Prosecution shall review the consolidated Indictment to ensure that phrases "included but not limited to" and "but not limited to these events" are not present therein contained the phrases. And the trial chamber further rejects and dismisses all other defence objections.
