Chapter Summary

Montenegro declared independence on 3 June 2006. Montenegro is not a member of the European Union. It has been a member of the Council of Europe since 11 May 2007. This chapter commences with the constitutional provisions, the relevant provisions of the Constitution of Montenegro of 19 October 2007. Next the chapter talks about Human Rights Related Legislation which includes Charter of Human and Minority Rights and Civil Liberties of 28 February 2003. Included in Penal Code Provisions is Criminal Code of 2003, as Amended up to 2008. The Draft Law on Prohibition of Discrimination of 2007 is included in the Non-Discrimination. Finally this chapter presents Protection Of Minorities and Equality Bodies / Ombudsman which talk about Law on Minority Rights and Freedoms of 2006 and Law on the Protector of Human Rights and Freedoms of 2003 respectively.
