Chapter Summary

Spain has been a member of the Council of Europe since 1977, and of the European Union since 1986. This chapter presents the relevant provisions of the Constitution of Spain of 1978, as amended up to 1992. It describes the penal code provisions, including penal code of 1995, as amended up to 2011, provision on non-discrimination, including law on social, fiscal and administrative matters of 2003. Further, the chapter discusses the provision on protection of minorities, including royal decree on the creation and regulation of the State Council of the Roma People of 2005, as amended up to 2006, and the provision on equality bodies/ombudsman, including organic law on the institution of the people's defender of 1981, as amended up to 1997.
