Chapter Summary

The matters dealt with in this part of the book are also dealt with in the numerous instruments for the international protection of human rights, in particular the International Covenant on Civil and Political Rights, 1966. Under this Covenant a State Party undertakes to ensure certain rights only to all individuals within its territory and subject to its jurisdiction. It is a general rule for the application of concurrent instruments of Human Rights - and Part II &t;Humane Treatment&t; is such an instrument - that they implement and complete each other instead of forming a basis for limitations. The chapter also describes three Articles: Article 4 on fundamental guarantees, Article 5 on persons whose liberty has been restricted, and Article 6 on penal prosecutions.
