Chapter Summary

The implementation of the European Economic Community (EEC's), and subsequently the EU's, market liberalization policies resulted in less State intervention and the liberalization of markets to competition. As a result there have been significant changes to competition law in Portugal during this period. Competition law in Portugal must be viewed in the context of the competition legislation in force within the EU with particular application to concentrations with a Community dimension. In Portugal, Decree-law 10/2003 created the Portuguese Competition Authority, henceforth referred to as the Competition Authority, approved its statutes and listed each sector regulator, totalling eleven. The National Institute of Civil Aviation, also referred to as INAC, was created by Decree-law 133/98, to regulate the aviation sector in Portugal and is one of the sector regulators provided for in the Competition Law and with which the Competition Authority is expected to articulate its functions.
