Chapter Summary

The Old Assyrian marriage contracts are limited almost exclusively on the endorsement fPN PN ehuz "the fPN has PN married", followed by clauses on the possibility of a second marriage, and/or on the consequences of divorce. The idea of marriage by purchase, has been developed especially for the ancient Babylonian law, by P. Koschaker and has long inventory. One of the arguments against marriage by purchase is the fact that the wife is just not an object and the property of her husband. This is, according to the marriage contracts more so in ancient Assyrian: both spouses have almost the same rights, as reflected in the divorce clauses in particular. Both partners have the option to divorce and both have to pay in case of doubt in unwarranted approach the same amount. The original text of the chapter is in German.
