13 Security, Piracy and Terrorism in the Straits of Malacca and Singapore

Chapter Summary

This chapter deals with two scourges of humankind: piracy/armed robbery and maritime terrorism, which are security threats to free and safe navigation and to the international community as a whole. Three sets of amendments to the current legal structures at the international, regional and national levels were proposed to make the system work better. Incidents of piracy in the Straits of Malacca and Singapore have reduced considerably and much of the credit for this is attributed to Association of Southeast Asian Nations (ASEAN) and sub-regional cooperation on piracy and transboundary crime control efforts. For the trial of these offenders by the rule of law, the Strait States of Singapore, Malaysia, Indonesia and Thailand should undertake a review of their national legislation. Strait States should accede or ratify the 2005 SUA Protocol and put in place appropriate organizational, administrative and operational procedures and arrangements86 to promote maritime provisions into domestic laws.
