Chapter Summary

The Administrative Tribunal of Québec (Tribunal administratif du Québec or TAQ) established, a conciliation process encouraging the settlement of proceedings. This chapter explains the different conciliation models offered, it is useful to situate the Administrative Tribunal of Québec within the Québec judicial system and identifies the various mediation and conciliation processes offered in Québec by other tribunals. Articles 151.14 to 151.23 of the CCP set forth the applicable rules on judicial mediation in first hearing, which is referred to as a settlement conference. The settlement conference aims to help parties communicate, negotiate and find solutions with a view towards settling their dispute. The constantly growing number of cases settled at the TAQ as a result of conciliation confirms without any doubt that conciliation as a dispute resolution mechanism remains a key to the fulfillment of the TAQ's objectives of affordability, accessibility and quality justice.
