Chapter Summary

The competence of fact-finding bodies to conduct hearings may be expressly provided for in the constitutive instrument, terms of reference or rules of procedure. Rule 77C of the Rules of Procedure of the Human Rights Committee also envisages hearings in the inter-State complaints procedure established by Article 41 of the International Covenant on Civil and Political Rights. The ILO Governing Body Committee on Freedom of Association may request and obtain from the Governing Body, authorization to hear the representatives of governments concerned before it submits its final recommendations to the Governing Body. This chapter provides some illustrations for the procedures of selected fact-finding bodies engaged in types of hearings with a view to distilling basic elements which should be present, as a minimum, in the procedure for the conduct of hearings by any fact-finding body in the field of human rights.
