In an action filed by three Dubai trading companies (the "plaintiffs") against a Dubai shipping agent and the owner of a vessel (the "defendants"), the Dubai Court of Cassation held that the shipping agent cannot be held responsible for the contractual obligations of the carrier, and further that according to Articles 275 and 285 of the UAE Maritine Code, the carrier will not be liable for damages or losses caused to goods on board a vessel, if the damages or losses are due to the vessel being subject to a UAE Judicial Arrest Order. This is unless it was evidenced that the owner of the vessel had bad faith or intentionally caused damage to goods or to the owners of the goods.
