This article tries to elaborate the relationship of the Rome Statute to the proclamation of an Amnesty and to the establishment of a Truth Commission process. The first part will examine whether the Statute prevents States parties from proclaiming an Amnesty. In the second part the question of whether the ICC has jurisdiction to deal with cases that are covered by a national Amnesty will be analyzed. The possible options of the Court in dealing with Amnesties and Truth Commissions will be evaluated as well as the effects of the Rome Statute on such Amnesties.
